WHAT THE LAW OF 01/01/1948 SAYS
Children of women born before 01/01/1948: the problem of the 01/01/1948 law can now be overcome through Sentence n. 4466, of 02/25/2009, which recognizes the right of transmission of citizenship to Italian women and their children born before the promulgation of the Republican Constitution on 01.01.1948. The decision to be applied administratively (through the Italian Consulates or Communes) needs to be standardized by the Italian Ministero Dell'Interno, which has not yet ruled on the matter. WHAT DOES THE LAW SAY ABOUT SEPARATED PARENTS?
- Children of single parents where the declarant of the child's birth is not the parent who transmits the Italian surname: for example, their parents are not married and the one who declared their birth was their father, but who transmits the Italian surname is their mother . In this case, the son cannot recognize Italian citizenship without the mother having already obtained it. Once the mother has recognized Italian citizenship, the child can also obtain it. The mother and child processes can be done simultaneously.
